Terms of Service

1. Who we are

DateNight is operated by Robert Riopel, Toronto, Ontario, Canada (“DateNight”, “we”, “us”). Contact: rriopel.design@gmail.com.

2. Who can use DateNight

To create an account, you must:

• be at least 18 years old;
• be located in Ontario (Canada) or Austria, where DateNight is currently available;
• be legally able to enter into this agreement;
• not have been banned from DateNight before; and
• not have been convicted of, or be required to register as an offender for, a sexual or violent offence.

You may have only one account, and it's for your personal, non-commercial use.

3. Your account

You sign in with Google. Keep that account secure; you're responsible for activity on your DateNight account. The information in your profile must be accurate and about you, and the photos must be of you.

4. How DateNight works

Members post dates (a plan at a public venue, at a time, for 2 to 6 people including the host) and other members request to join. The host decides who joins. A short chat opens 24 hours before the date, with a limit of three messages per person. See how it works.

Dates take place at independent venues. DateNight doesn't run, book or pay for venues; any costs of a date (food, drinks, tickets) are between you, the other people and the venue.

5. Community rules

When you use DateNight, you agree not to:

• harass, threaten, intimidate, stalk or pressure anyone, on DateNight or at a date;
• post or send anything hateful, discriminatory, violent, sexually explicit or illegal, including nudity in photos;
• impersonate anyone, misrepresent your age or identity, or use someone else's photos;
• involve anyone under 18 in any way;
• ask for or offer money, gifts or financial information, or run any scam;
• use DateNight to advertise, sell, recruit or solicit, including for sex work;
• post a date you don't intend to attend, or at a private home;
• share other members' personal information or chats outside DateNight without their consent;
• scrape, copy or harvest data from DateNight, or use bots or automated tools; or
• try to get around our security, access other accounts, or interfere with the service.

Consent matters on DateNight and at every date. Agreeing to meet is not agreeing to anything else, and anyone can leave a date at any time.

6. Your content

You own what you post (your photos, profile, dates and messages). You give DateNight a non-exclusive, worldwide, royalty-free licence to host, store, display and transmit that content only to operate DateNight, for example to show your profile to other members. The licence ends when you delete the content or your account, except for copies we must keep by law. You confirm you have the rights to everything you post.

7. Safety and your responsibility

We work to keep DateNight safe (see our safety page), but we don't verify members' identities, run background checks, or supervise dates. You're responsible for your own interactions with other members, online and in person. Please take sensible precautions, and report anyone who breaks these rules.

8. Reports, moderation and termination

We review reports and may remove content, cancel dates, limit features, or suspend or ban accounts that break these terms or put others at risk, with or without notice where safety requires it. If we close your account for a serious breach, you may not create a new one.

You can stop using DateNight and delete your account at any time in Profile → Settings → Delete Account.

9. Price

DateNight is free during the beta. If we introduce paid features, we'll explain the price and terms clearly before you buy anything, and you'll never be charged without agreeing first. See our refund policy.

10. The beta

DateNight is in beta. Features may change or be removed, and the service may sometimes be unavailable or have errors. We provide it “as is” and “as available”.

11. Liability

To the extent permitted by law, DateNight isn't liable for the conduct of members on or off the app, or for indirect or consequential losses. Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by our negligence, for intent or gross negligence, or your rights as a consumer under the laws of the country you live in.

12. Privacy

Our Privacy Policy (or, in Austria and the EU, our Austria / EU Privacy Policy) explains how we handle your personal information.

13. Changes to these terms

We may update these terms as DateNight grows. For significant changes, we'll tell you in the app or by email before they take effect. If you don't agree, you can delete your account; continuing to use DateNight after the change means you accept the new terms.

14. Governing law and disputes

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If you're a consumer living in the EU, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts.
